General Conditions
Description of the service.
The website Hotel-eu.net was
created to act as an intermediary between Internet and the companies supplying
accommodation services or other services like for example car
rental. Iberdom,
the company that manages the website is not a reservation centre, a wholesaler or
services or a travel agency. The main aim is to provide the widest range of
accommodation in different countries and languages so that our ‘Internet user’
clients can choose any of the services (hotel, car, etc) that are offered
through the website and hire it online.
Contents of the page.
The objective of making
the page is to present it with a simple yet neat layout. Each
establishment is presented in two ways. The first time as accommodation in the town where it is located and the
second time on a whole page called ‘associated page’ or else ‘technical card’
of the establishment. All the information, including the ‘technical details’ of
each establishment, description of the products or services, photos, prices,
information on offers and discounts displayed on our webpage are provided, updated and
maintained by the hotels or suppliers of the services offered on our webpage Hotel-eu.net.
Obligations of the client.
Iberdom offers
a free unlimited use of their webpage to Internet users under the condition
that before making a reservation, they must learn and respect the site’s
conditions and those of each establishment or service supplier. In the case of
hotels, the conditions are set and provided by them on the ‘technical card’
attached to each establishment.
The
reservation, acceptation of the conditions and payment.
In order to make a
reservation, clients must duly fill in the form with their personal details
and, to complete the reservation process, they must also fill in the credit or
debit card payment form. Upon making
payment, clients accept the terms and conditions of purchase of the web page as
well as the basic conditions of the establishment they have chosen.
All services hired through our
webpage shall be charged when the reservation process is successfully completed
(unless the establishment has other requirements, which must be duly indicated
on the establishment page). Immediately after making the reservation and
accepting the conditions both of Iberdom and the establishment, we send the ‘Confirmation
of reservation’ to the client with all the details of his/her hired
reservation. We kindly ask clients to present it when they check in at their
selected establishment.
The payment process is made between the client and the financial institution.
Hotel-eu.net has no access to the forms and/or details of the payment process. We
shall only receive the confirmation of the payment approval. The system used for the security of the transactions
is only the SSL –Secure Socket Layer- type system for safe transactions. A
reservation made for more than 14 days (12 nights) has to be approved by the
selected establishment.
Overbooking.
In the unlikely event
of overbooking, the hotel has to find alternative accommodation of the same
category than that hired by the client, as well as cover any additional cost involved
as a result of it.
Cancellation of the reservation.
Reservations may be cancelled provided
the requirements of the hotels are met, without this involving any charge for Hoteles-eu.net.
However the financial institution will charge the transfer fee for the
reservation total. All the hotels have their own reservation cancellation
conditions. Each associated page of the hotel (‘technical card’) includes the
conditions of the reservation cancellation together with a time limit. If the client
does not comply with the conditions of the reservation cancellation or fails to
appear at the establishment, the actual establishment will charge the client
the administration fee corresponding to one night stay. Hotel-eu.net shall
reimburse the client the remaining amount of the total paid after receiving
confirmation from the establishment about the fact that the hired service has not
been used. The financial institution shall not reimburse the transfer fee
charged by them.
Privacity.
All the employees at
Iberdom are trained and motivated to act to the highest ethic standards. Pursuant
to Spanish constitutional act Ley Orgánica 15/1999 of December 13 on personal
data protection (LOPD), all the data received about our clients from
information forms, e-mails, or over the customer care telephone are protected
in our database. The users of such information are solely the departments that make up Iberdom (responsible
of the database), financial institutions and collaborating bodies for the
purpose of carrying out their duties and corporate aim (they only have access
to such information pursuant to section 12 of the LOPD, without this implying
facilitating any details), as well as of providing details to any public or
private institutions that by law request so. If you wish, you may access,
rectify, cancel and oppose the above by contacting Iberdom S.L., Customer Care

Responsibilities
and limitations
The responsibility resulting from
the non-compliance with the conditions set down in the currently in force law
regarding the hiring of the services offered by each supplier to clients is
only and exclusively such suppliers’.
Iberdom S.L. is not
responsible of any damage that may directly or indirectly result –stately and
not limitative- from any inference, omission, interruption, computing virus,
breakdown, and/or disconnection in the operative performance of this electronic
system, or in the computing machine and equipment if users, that are caused by
a third party, other than Hotel-eu.net.
Iberdom S.L. is exonerated of any compensation to the final client as for the
latter the service obtained is completely free.
Iberdom S.L. is not
responsible of any mistake made by suppliers or clients as a result of a misuse
of the services in the course of the reservation process and/or resulting from
force majeure that are unforeseeable and insurmountable
The clients’ total or
partial manipulation, reproduction and/or storing of the hotel webpage hotel-eu.net
is totally forbidden with a profit-making and commercial aim. Both the contents
and the source codes remain the property of Iberdom S.L. and are in compliance
and protected by the intellectual property law.
Without any prior
notice,
Iberdom S.L. can make
changes, configurations, presentations and updating of the webpage information
contents.
Iberdom S.L. reserves
the right to request additional information to those clients whose reservations
do not pass the safety controls of our webpage or else totally deny a
reservation for that reason.
The parties agree to
expressly submit to the arbitration of the Chamber of Commerce of Malaga for
any issue regarding the interpretation, compliance or disagreement on the
current terms and conditions. The present agreement takes place at the place where the electronic
service supplier, that is, Iberdom, S.L., is based, that is, Malaga, by virtue
of the Spanish act Ley 34/2002, dated
July 11 on the services of the society of information and electronic commerce,
that is applicable to what is not expressly included in the present agreement,
with regard to the transactions and/or electronic commerce services Iberdom S.L.
renders.
